Sentencing delayed in contractor's Fair Trading Act case

Sentencing has been delayed in the case of an unlicensed area contractor who previously pled guilty to infractions under the province’s Fair Trading Act.

Kieron Warren pled guilty in July to five charges: three counts of operating as a contractor without a pre-paid contractor's licence and two counts of failing to provide a refund after a customer cancelled a contract.

Warren was scheduled to be sentenced in Calgary Oct. 2 but appeared in court with a new lawyer, Sean Fitzgerald of Calgary firm Miles Davison LLP, whom he had not formally retained.

The case has been adjourned to Oct. 16, at which time a new date for sentencing is expected to be set.

The case stems from incidents that date back to 2007 and 2008 when Warren operated under the business name Hillcrest Renovations.

Under the Fair Trading Act, clients can ask for a full refund upon cancelling a contract, and contractors must repay the amount in full within 15 days.

Warren is also under investigation for allegedly defrauding at least 10 families of a combined $500,000 over the past year-and-a-half under a new company, KREATE Cabinets.

He is accused of leaving homes in a gutted state in several Calgary-area communities, including Okotoks, Springbank and Chestermere.

Warren has been a resident of Redwood Meadows for the past year. He moved to the townsite from Springbank.

Multiple families have filed complaints with Service Alberta under the Fair Trading Act, which states only licensed contractors are allowed to accept prepayment for work before it has been completed.
